Who may ask for an official opinion?
Only public officials may ask for and receive official opinions. The Attorney General may not issue official opinions to anyone else.
How does a public official request an opinion?
The law requires the public official to send a letter to the Attorney General stating all the relevant facts and asking the legal question he or she needs answered. Mail your official request to P.O. Box 220, Jackson MS 39205.
How long does it take to get an official opinion?
75% or more of all requests are answered within 30 days or less.
What good is an official opinion?
If the public official acts in accordance with the opinion, he or she cannot be held civilly or criminally liable for those acts.
Do old opinions protect a public official from liability?
No. Only an opinion asked for by, and addressed to, the public official will provide him or her with immunity from liability. Prior opinions are posted on this website for general guidance and information but do not provide protection from liability.
